Murder accused, AJ Lubbe, out on bail for Ruimsig taxi shooting

Part of the affidavit read out by Kruger indicated that his client (Lubbe) was apologetic for his actions; sought to participate in rehabilitation programmes and was in dire need of medical and psychiatric treatment.

Johannes Lubbe, the man accused of brazenly shooting a taxi driver in Ruimsig in July, was granted bail of R10 000 when his bail application was heard in the Randburg Magistrates’ Court on Monday, 7 October.

The accused’s lawyer, Jannie Kruger, delivered Lubbe’s reasons for requesting bail, which was granted by the court, but under very strict conditions.

Part of the affidavit read out by Kruger indicated that his client (Lubbe) was apologetic for his actions; sought to participate in rehabilitation programmes and was in dire need of medical and psychiatric treatment.

These reasons were not argued by the State Prosecutor, who left the decision in the Magistrate’s hands.

The Magistrate said she was satisfied to grant the accused bail on the grounds that he needed medical attention; however, she showed concern about his behaviour. She then went on to grant Lubbe bail of R 10 000, under the following conditions: He attends court on days he is set to appear; he is to reside at the address stated in the affidavit and not leave the address unless he is attending a medical institution or work; all firearms are to be seized from him prior to his release, and he is to refrain from any violence during the time it takes to finalise his case.

His lawyer reflected on the bail conditions after the proceedings. “He received very strict bail conditions. His bail was set at R10 000 with house arrest. He does not have to report to the Police Station, but a Correctional Services official will visit him unannounced to see where he is. He has to report his whereabouts to this officer as well,” he said.

When asked whether Lubbe will be returning to work, Kruger said, “He can go to work, but at this stage, medical treatment is more important. He’s got to be admitted to a psychiatric or medical clinic”.

Kruger also emphasised that his firearms will be taken away from him before his release.

Son shoots father dead

Lubbe, who faces a case of attempted murder and possession of an unlicensed firearm, was remanded in custody until 1 November for his release.

The condition of the taxi driver he shot during the alleged road-rage incident outside the Ruimsig Boulevard Shopping Centre is still unknown.

This is not the first time that Lubbe has been in trouble with the law involving a firearm. In 2016, he was arrested and went on trial for shooting and killing his father, Andries Johannes Lubbe, at their Poortview residence. The Northsider’s sister publication, the Roodepoort Record reported at the time that he had shot his father seven times following an alleged altercation.
