Millions of fines to be scrapped

RTIA ordered to pay Fines4U's legal costs.

A substantial number of motorists can breathe a sigh of relieve after the High Court has ruled that millions of traffic fines have to be scrapped.

This past Friday (24 February) the High Court found that all fines issued since 2008 that did not comply with the time restrictions in terms of the Administrative Adjudication of Road Traffic Offences (Aarto) Act, must be nullified. This comes after Fines4U approached the court on behalf of its client, Audi Johannesburg. The Road Traffic Infringement Agency (RTIA) was ordered to cancel all affected fines. Unfortunately this will not be the case where affected fines have already been paid.

The RTIA laid the blame at the feet of the Post Office’s tardy service but Judge Bill Prinsloo rejected the argument.

In 2015/ 16 alone the Johannesburg Metro Police issued 5,3 million fines.

The RTIA was ordered to pay Fines4U’s legal costs.
