New Waste Management by-laws for businesses and households

Families and small business should familiarise themselves with new laws.

The new Waste Management by-laws that came into effect on 30 July will effect households and business.

According to the new laws any person who generates hazardous or health-risk waste (other than the normal type and quantities generated in a household) must prepare an Integrated Waste Management Plan (IWMP) setting out the provisions for managing, storing, treating, collecting, transporting and disposing of health care risk waste.

Such a person also must provide proof that he/she will be using an accredited service provider and provide a copy of a valid public health permit if required.

Waste generators who are generating domestic waste, general business waste and dailies (ie restaurants) must place the waste in an approved waste receptacle. Animals must be controlled in such a way that they do not interfere with waste and no objects that can harm Council workers, such as glass or hot ash, may be put in receptacles.

Waste receptacles must be closed, kept hygienic, not damaged and kept out of the public’s view except on collection days. Receptacles also may not be used for any other purposes.

Dailies (ie restaurants) waste must be stored in a position that will allow the collection and removal of the waste by Council employees without hindrance. They must not be more than 20m from the entrance to the premises but in certain cases special permission may be obtained for alternative placing.

The owner of a premises must pay the service fee regardless of whether he or she uses the service and non-recievement of an account does not exempt an owner of paying.

As to the transportation of waste, the vehicle body size must be of adequate size and construction for the type of waste being transported must be clean, roadworthy and sanitary. No waste is allowed to become detached, leak or fall from a vehicle, except at the waste facility and should there be a spill, the transporter must clean up the spilled contents.
