Before sentencing Benett, Magistrate Baloyi gave him the opportunity to pay back the money before deciding what sentence to impose. Thus far Benett has paid the complainant, Justin Swanepoel (who made the wrongful deposit in 2014), about R520 000. He has undertaken to pay the rest in monthly installments of R20 000. Benett, who was previously convicted for fraud, has asked the State to impose a sentence of house arrest instead of jail time in order to be able to work and pay back the money.

In September 2014, Swanepoel accidentally paid the money meant for a client into Benett’s account. Within a few days, Swanepoel realised his mistake, but Benett had already spent almost all of the money.
